3. Cancellation Policy
Before Project Commencement
Clients may request cancellation before project work begins.
Any advance payment received may be refunded after deduction of:
- Consultation Charges
- Requirement Analysis Charges
- Administrative Costs
- Payment Gateway Charges
- Applicable Taxes
After Project Commencement
Once project work has started, cancellation requests may be accepted at the sole discretion of NG Softech.
The Client shall be liable to pay for:
- Work completed
- Resources allocated
- Design work completed
- Development work completed
- Third-party expenses incurred
Any remaining amount, if applicable, may be refunded after deductions.
4. Non-Refundable Services
The following services are strictly non-refundable:
Domain Registration
All domain registration, renewal, transfer, and restoration fees are non-refundable once processed.
Web Hosting Services
Hosting fees are non-refundable after hosting account activation unless otherwise stated in a separate written agreement.
SSL Certificates
SSL certificate purchases and renewals are non-refundable once issued.
Software Licenses
Third-party software licenses, plugins, themes, API subscriptions, and software purchases are non-refundable.
Bulk SMS Services
Credits purchased for Bulk SMS services are non-refundable once credited to the client account.
Bulk WhatsApp Services
WhatsApp messaging credits, setup fees, verification charges, and platform fees are non-refundable.
Digital Marketing Services
SEO, SMO, Content Marketing, Social Media Marketing, and advertising setup charges are non-refundable once work has commenced.
5. Website, Software & App Development Projects
For custom development projects:
- Payments made for completed milestones are non-refundable.
- Design approvals provided by the Client shall be considered final.
- Delays caused by the Client do not qualify for refunds.
- Change of business plans, business closure, management changes, or personal reasons shall not qualify for refunds.
If a project is abandoned by the Client for more than 30 days without communication, NG Softech may close the project and no refund shall be payable.
6. Refund Processing
Where a refund is approved:
- Refunds shall be processed using the original payment method wherever possible.
- Refund processing may take 7 to 30 business days.
- Bank, payment gateway, transaction, and processing charges may be deducted.
- GST and government taxes already deposited may not be refundable.
7. Service Suspension Due to Policy Violations
No refund shall be provided if services are suspended or terminated due to:
- Cyber Fraud
- Phishing Activities
- Spam Activities
- Illegal Content
- Copyright Violations
- Trademark Violations
- Misuse of Hosting Services
- Violation of Applicable Laws
- Violation of NG Softech Policies
8. Chargebacks and Payment Disputes
Before initiating any chargeback or payment dispute, clients agree to contact NG Softech to attempt resolution.
If a chargeback is initiated:
- Services may be suspended immediately.
- Access to hosted services may be restricted.
- Recovery and legal costs may be charged to the client where permitted by law.
9. Third-Party Service Charges
NG Softech shall not be responsible for refunds relating to:
- Domain Registrars
- Hosting Providers
- Cloud Service Providers
- SMS Gateway Providers
- WhatsApp Service Providers
- Payment Gateway Providers
- Advertising Platforms
Any refunds for third-party services shall be subject to the policies of the respective provider.
10. Force Majeure
Refunds shall not be provided for delays or interruptions caused by circumstances beyond the reasonable control of NG Softech, including:
- Natural Disasters
- Government Restrictions
- Internet Outages
- Cyber Attacks
- Power Failures
- Third-Party Service Failures
11. Limitation of Liability
Under no circumstances shall NG Softech be liable for:
- Loss of Business
- Loss of Revenue
- Loss of Data
- Loss of Customers
- Loss of Profits
- Indirect or Consequential Damages
arising from service cancellation, suspension, or refund decisions.
