Acceptable Use Policy (AUP)

This Acceptable Use Policy (“AUP”) governs the use of services provided by NG Softech, including but not limited to Website Design, Website Development, Software Development, Mobile Application Development, Hosting Services, Domain Services, SEO Services, SMO Services, Content Marketing, Bulk SMS Services, Bulk WhatsApp Messaging Services, Digital Marketing Services, and related technology solutions.
By using any service provided by NG Softech, you agree to comply with this Acceptable Use Policy.
1. Purpose
The purpose of this AUP is to ensure the lawful, ethical, and secure use of NG Softech services and to protect our infrastructure, clients, partners, and the public from misuse.

Clients shall not use NG Softech services for any activity that is unlawful, fraudulent, harmful, abusive, deceptive, or violates applicable laws or regulations.

3. Bulk SMS and WhatsApp Usage
Clients using Bulk SMS or WhatsApp Messaging services must:
- Obtain lawful recipient consent where required.
- Follow applicable telecom and messaging regulations.
- Follow WhatsApp Business Platform Policies.
- Avoid misleading, deceptive, or fraudulent messaging.
NG Softech reserves the right to suspend messaging services immediately if abuse is detected.
4. Hosting Services Usage
Clients hosting websites, applications, software, or digital content on infrastructure provided through NG Softech must ensure that such content:
- Complies with applicable laws.
- Does not facilitate fraud or cybercrime.
- Does not distribute malicious code.
- Does not violate intellectual property rights.
- Does not impersonate individuals, businesses, or government entities.
NG Softech does not routinely monitor client content but reserves the right to investigate complaints and take appropriate action.
5. Security Obligations
Clients are responsible for:
- Maintaining strong passwords.
- Securing access credentials.
- Updating software and applications.
- Protecting customer data.
- Implementing reasonable security measures.
Clients must promptly notify NG Softech of any suspected security breach or unauthorized access.
6. Compliance with Laws
Clients agree to comply with all applicable laws and regulations, including but not limited to:
- Information Technology Act, 2000 (India)
- Digital Personal Data Protection Act, 2023
- TRAI Regulations
- Consumer Protection Laws
- Intellectual Property Laws
- Anti-Spam Regulations
- Applicable International Laws where relevant
7. Investigation of Violations
NG Softech reserves the right to:
- Investigate suspected violations.
- Request information and documentation.
- Suspend services during investigation.
- Remove content where legally required.
- Cooperate with law enforcement agencies.
Failure to cooperate with an investigation may result in service suspension or termination.
8. Service Suspension and Termination
NG Softech may suspend or terminate services immediately without prior notice if:
- Fraudulent activity is suspected.
- Illegal content is detected.
- Law enforcement requests action.
- Regulatory authorities issue directives.
- The client violates this AUP.
Suspension or termination under this policy may occur without refund.
9. Reporting Abuse
If you believe a website, application, hosting account, SMS campaign, WhatsApp campaign, or other service associated with NG Softech is being used unlawfully or abusively, please report the matter to:

10. Limitation of Liability
NG Softech acts solely as a technology service provider.
NG Softech shall not be liable for:
- Actions of Clients
- Client Content
- Customer Disputes
- Financial Losses Caused by Clients
- Fraudulent Activities Conducted by Clients
- Regulatory Violations Committed by Clients
The Client remains solely responsible for all activities conducted using services provided by NG Softech.
11. Cooperation with Authorities
NG Softech may disclose account information, logs, records, communications, or other relevant information when required by:
- Applicable Law
- Court Orders
- Government Agencies
- Law Enforcement Authorities
- Cybercrime Investigation Agencies
12. Changes to this Policy
NG Softech reserves the right to modify this Acceptable Use Policy at any time.
Any updated version shall become effective immediately upon publication on the official website.
